It is not legal in the Czech Republic to distill spirits without a legal permit. The sale / relocation of distillation equipment is subject to notification. The conditions for the production of distillates in the Czech Republic are defined by the Alcohol Act No. 61/1997 Coll.

Spirits may only be produced and processed in a distillery or special distillery by a legal or natural person who has been issued a state permit under a special law, unless it is a grower distillery. This permit shall be issued by the Ministry of Agriculture or the Ministry of Industry, depending on how the alcohol is obtained.

In the case of grower distillation, the Ministry of Agriculture shall issue a permit based upon a written application. The applicant shall attach a description with a sketch of the layout and technical documentation.

The Alcohol Act further specifies:

  • the substances from which alcohol may be produced
  • the maximum quantity of alcohol to be produced
  • registration requirements for the substances from which alcohol may be produced
